1. Changes to Terms of Service

You may review the most current version of these Terms of Service at any time on this page.

We reserve the right to update, change, modify, add, remove, or replace any part of these Terms of Service at any time, for reasons including changes in applicable law or regulatory guidance, decisions of a court or competent authority, changes to the Website or the introduction of new features. Where a change is material — in particular any change to Section 4 (Displayed Reviews and Ratings), Section 7 (Limitation of Liability), or Section 8 (Indemnification) — we will post notice of the change on the Website at least thirty (30) days before it takes effect. Changes that are not material, and changes we are required to make immediately in order to comply with applicable law, take effect on the “Last updated” date shown at the top of these Terms of Service.

Your continued use of or access to the Website after a change has taken effect constitutes your acceptance of that change. If you do not accept a change, you should stop using the Website. No change applies retrospectively to Displayed Content that was shown on the Website before the change took effect, unless the change is required by applicable law.

2. Intellectual Property

All information and content provided on the Website, including, but not limited to, trademarks, logos, service marks, slogans, product names, text, original artwork, graphics, button icons, photographs, images, screenshots, video and audio clips, music, digitally downloadable files, data compilations, software, and the compilation and organization thereof (collectively, the “Content”), are subject to copyright, trademark, service mark, trade dress, and other intellectual property rights or licenses held by Amorepacific Corporation, its affiliates, partners, or licensors. The Content is protected by the laws of the Republic of Korea, applicable international laws, and other relevant intellectual property laws.

You are authorized to access and view the Website and related Content solely for your personal and non-commercial use. Without our prior written or electronic approval, you may not copy, download, reproduce, modify, publish, distribute, transmit, transfer, display, sell, license, create derivative works from, or otherwise commercially exploit any part of the Website or Content.

Any unauthorized use of the trademarks, service marks, trade dress, copyrighted materials, or other Content displayed on the Website is strictly prohibited.

For the avoidance of doubt, this Section does not apply to Displayed Content, which is governed by Section 4 (Displayed Reviews and Ratings).

3. Use of the Website

You agree to use the Website only for lawful purposes and in accordance with these Terms of Service.

You are prohibited from using the Website to:

- Engage in any activity that is fraudulent, abusive, unlawful, or otherwise prohibited by applicable laws and regulations.
- Interfere with or disrupt the operation, security, or functionality of the Website.
- Interfere with another user’s access to or enjoyment of the Website.
- Attempt to gain unauthorized access to the Website, its systems, servers, networks, or related services.
- Transmit viruses, malicious code, or any other material that may damage or interfere with the Website or related systems.
- Transmit or publish any material that is unlawful, harmful, threatening, abusive, defamatory, offensive, or otherwise objectionable.
- Use the Website or its Content for any unauthorized commercial purpose, including but not limited to scraping, data mining, or automated collection of Content.

We reserve the right to restrict, suspend, or terminate access to the Website if we reasonably determine that a user has violated these Terms of Service or applicable laws and regulations.

4. Displayed Reviews and Ratings

4.1 Scope and Sources

The Website displays product reviews, star ratings, and related materials (collectively, “Displayed Content”) provided through the platform of our third-party review service provider (currently Bazaarvoice, Inc.). The Website does not contain any submission form or interactive feature for users to submit content.

All Displayed Content is written by members of a consumer community operated by our review service provider, including members who received a product through a product-sampling programme in which we participate. That content is submitted on the provider’s own platform, under the provider’s own terms of use, and is made available for display on the Website through our agreement with that provider.

4.2 Disclosure of Incentives

Where a review displayed on the Website was submitted by an author who received the product free of charge, at a discount, or who received any other product, service, payment, or benefit from us or on our behalf, that review is identified with an indicator such as “Received Free Product”, and it is included in the aggregate disclosure stating how many of the displayed reviews were incentivised. For a given product, all or substantially all of the displayed reviews may have been submitted under a product-sampling programme operated by our review service provider; the aggregate disclosure shown alongside the reviews states the number concerned.

We take reasonable and proportionate steps to prevent and to remove Displayed Content that is false, that does not reflect a genuine experience of the product, or that conceals an incentive. Those steps include the moderation described in Section 4.3 and the authenticity assessment described in Section 4.7.

If you believe that any review displayed on the Website is fake or conceals an incentive, please tell us using the contact details in Section 11.

4.3 Publication and Removal

All Displayed Content is moderated by our review service provider before it is made available for display on the Website. We do not guarantee that any particular content will be displayed or will remain displayed.

To the extent permitted by applicable law, we may change, condense, withhold publication of, refuse to post, remove, or delete any Displayed Content that we or our review service provider determine violates these Terms of Service, applicable law, or our content guidelines. Any such decision is made by reference to those standards and in a diligent, objective, and proportionate manner.

Where Displayed Content is removed from the Website, we will — to the extent required by applicable law — inform the author of that decision and of the reasons for it, provided the author’s contact details are available to us through our review service provider. If the author considers the decision to be incorrect, they may contact us using the details in Section 11, and we will review the request and inform them of the outcome within fourteen (14) business days.

Any person may notify us of Displayed Content on the Website that they consider to be unlawful, using the contact details in Section 11. A notice should identify the content concerned and explain why it is considered unlawful. We will handle such notices in a timely, diligent, non-arbitrary, and objective manner, and will inform the notifying person of our decision.

4.4 Limits of Responsibility

Moderation of Displayed Content is performed by our review service provider before the content is made available for display on the Website. It is not a guarantee that every breach of applicable law will be detected. Our display of any Displayed Content does not constitute an endorsement of that content.

Displayed Content reflects the views of the individual who submitted it on the platform of our review service provider, and does not reflect the views of Amorepacific Corporation or its affiliates.

4.5 Public Display

Displayed Content is publicly accessible by anyone visiting the Website. Reviews are displayed together with the display name chosen by the author on the platform of our review service provider.

Optional information such as location, age, or gender that an author provides on the platform of our review service provider may be displayed alongside the review, depending on the Website’s configuration at the relevant time.

4.6 Requests for Removal

If you believe that any Displayed Content on the Website infringes your rights or is unlawful, please contact us using the details in Section 11. We will review such requests and respond within fourteen (14) business days.

Because Displayed Content is hosted and distributed by our review service provider, removal from the Website will be communicated to that provider for further action across its network. Where your request concerns a right under applicable data protection law, we will handle it in accordance with that law and our Privacy Policy.

4.7 Service Provider and Authenticity

The review, rating, and question-and-answer features on the Website are provided through the platform of a third-party service provider (currently Bazaarvoice, Inc.). User Content, and the email address associated with it, are processed and stored on the systems of that provider and its sub-processors, located principally in Ireland and in the United States, and are subject to that provider’s authenticity assessment and moderation procedures, supported by anti-fraud technology and human analysis. A current list of the countries concerned is set out in our Privacy Policy.

Some Displayed Content is written by members of a consumer community operated by that provider, including through product-sampling programmes in which we participate. Those members submit their content on the provider’s platform and are subject to the provider’s own terms of use, including its minimum age requirement, its content standards, and its incentive-disclosure requirements. Content submitted through that community is subject to the same authenticity assessment and moderation procedures before it is displayed on the Website.

Details of the international transfer of personal information in connection with these features, including any transfer arising from the display of Displayed Content on the Website, are set out in our Privacy Policy.

5. Third-Party Links

Certain content and services available through the Website may include materials, websites, services, or purchasing channels operated by third parties.

Links to third-party websites, including external retailers and other purchasing channels, are provided solely for your convenience. The inclusion of a third-party link does not constitute our endorsement, approval, or guarantee of the referenced website, content, product, service, retailer, or supplier.

Third-party websites are governed by their own terms, policies, and practices. We do not control and are not responsible for the availability, accuracy, security, content, privacy practices, products, services, or transactions of any third-party website.

- Your violation of any applicable law or regulation.
- Your violation of the rights of any third party.
- Your violation of the intellectual property or other rights of any third party in connection with your use of the Website.

This Section applies only to the extent permitted by applicable law. Where you are a consumer, you are liable under this Section only for loss caused by your own intentional or negligent breach, and only for loss that was a reasonably foreseeable consequence of that breach. Nothing in this Section affects any mandatory consumer protection to which you are entitled under the law of the country in which you are habitually resident.

9. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law principles.

Any dispute, claim, action, or proceeding arising out of or relating to the Website or these Terms of Service shall be subject to the jurisdiction of the competent courts located in Seoul, Republic of Korea, unless otherwise required by applicable law.

If you are a consumer, nothing in this Section deprives you of the protection afforded by provisions that cannot be derogated from under the law of the country in which you are habitually resident, and nothing in this Section limits your right to bring proceedings in the courts of that country, or requires you to defend proceedings outside those courts, where the applicable law so provides.

10. Miscellaneous

We shall not be held liable for any delay or failure in performance caused, in whole or in part, by circumstances beyond our reasonable control, including, without limitation, acts of God, natural disasters, severe weather conditions, fires, accidents, explosions, labor disruptions, acts of war, acts of terrorism or threatened terrorism, governmental actions or restrictions, civil unrest, epidemics, pandemics, quarantines, shortages, failures of communication systems or power supplies, or other catastrophic events.

If any provision of these Terms of Service is determined to be unlawful, invalid, void, or unenforceable, that provision shall be deemed severable from these Terms of Service and enforced to the fullest extent permitted by applicable law. The remaining provisions shall remain valid and enforceable.

Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

The provisions set out in Section 4 shall survive any termination of these Terms of Service or of your use of the Website.

These Terms of Service, together with any policies or operating rules posted on the Website, constitute the entire agreement between you and us regarding your use of the Website, and supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, relating to the Website. Nothing in this paragraph excludes liability for fraudulent misrepresentation, or affects any statement or assurance made to you on which you were entitled to rely.

These Terms of Service are provided in English and in Korean. In the event of any inconsistency between the two versions, the English version prevails, except where the law applicable to you requires that the version in your own language prevail.
